ABC News Interview: Continuing investigation into death at adult day program

Justin McCafferty, a 22-year-old with special needs, fell to his death while he was at the Fort Monmouth Day Program in Oceanport. ABC Eyewitness News recently reported that the Monmouth County Prosecutor’s Office and Oceanport Police are investigating Justin’s tragic death.

Kimberlee McCafferty, Justin’s Mother, signed up her son for the Fort Monmouth Day Program to give him more social interaction and field trips.

His care instructions required direct line of sight supervision from a direct support professional at all times.

“They can’t have had direct line of sight [supervision] or he would still be here,” Kimberlee stated on the evening news broadcast.

ECZ attorney and shareholder, Daryl Zaslow, represents the McCafferty family and calls the incident “beyond negligent.”

“When you go into the business of taking care of the most vulnerable of our society,” said Zaslow, “you take on an enormous responsibility and there’s no room for error. What we really want to see is accountability… we want to make sure he gets justice and the family gets justice.”

“He was a wonderful, affectionate, loving son and brother,” Kimberlee said. “This has destroyed my family and I am devastated beyond repair. He was the light of our lives.”
