New details emerge about the tragic death of a young man with special needs at an adult day program as the investigation unfolds

Justin McCafferty, a 22-year-old with special needs, fell to his death while he was at the Fort Monmouth Day Program in Oceanport, New Jersey.

ABC Eyewitness News interviewed Justin’s mother Kimberlee and the family’s attorney Daryl Zaslow with Eichen Crutchlow Zaslow, LLP.

Kimberlee explained that Justin’s care instructions required “direct line of sight supervision from staff and a direct support professional at all times.” She believes if he had gotten the attention he needed, he would still be alive today. She also shared how hard it is living without him and the tragic experience of getting the news about her son.

Zaslow called the incident “beyond negligent.”

“When you care for the most vulnerable people with autism and other disabilities, you take on an enormous responsibility,” Zaslow stated. “When you do not live up to that responsibility, a horrible thing can happen. This is the most horrible thing that can happen.”

More details emerged as other outlets reported on the incident. CBS News reported that Zaslow has gotten few answers from the facility, but he believes Justin was left unattended for an extended period of time.

NewJersey.com reported that the staff “lost track of Justin” which led to his fall. “We are deeply saddened by this incident, are in contact with law enforcement, and are unable to comment further at this time due to the ongoing investigation.”

Justin’s obituary states, “He loved spending time with his family, making new friends, playing with his collection of musical toys, and adored a good cuddle.”

New Jersey 101.5 reported that the McCafferty family is suing for $35 million.
