$2,150,000 Settlement for Failure To Diagnose Vascular Defect

William O. Crutchlow, Esq. of Eichen Crutchlow Zalsow, LLP with offices in Edison, New Jersey and Toms River, New Jersey recently settled a case arising from the death of a young woman following a failure to diagnose a defective blood vessel in her brain and associated “warning bleeds”. Our client began experiencing severe headaches shortly after giving birth to her first child. She was evaluated in an Emergency Room where the doctor failed to order appropriate imaging studies and failed to seek necessary consultation with a neurologist. The next day, the vascular defect burst causing a large hemorrhage and severe brain damage that ultimately led to her death. She left behind her husband and newborn baby. Bill worked closely with experts in Emergency Medicine and Neurosurgery to establish that a proper evaluation in the Emergency Room would have led to an accurate diagnosis and permitted timely surgical intervention with a good chance for a favorable outcome. We also engaged experts in Stroke Neurology and Forensic Economics to establish a compelling brain injury and economic loss picture. This case was settled at the conclusion of discovery after several negotiation sessions with the Court.
