$4,000,000 for Misdiagnosis Leading to Vision Loss
William Crutchlow, Esq. of Eichen Crutchlow Zaslow, LLP with offices in Edison, New Jersey and Toms River, New Jersey recently accomplished a $4,000,000 settlement for a client who lost vision due to a delay in the diagnosis of an infection. Our client, who had a history of a prior liver infection, presented to an Urgent Care clinic twice in a three day period of time with complaints of abdominal discomfort, fatigue, lethargy and systemic illness. Nothing was done to assess for or treat an infection in the abdomen. The day following the last Urgent Care visit, our client awoke with severe infection in both eyes. Despite the best efforts of the doctors who saw him that day, the infection had progressed to the point where it had destroyed our client’s vision. William Crutchlow worked closely with experts in internal medicine, emergency medicine and infectious disease to establish that there was an infection involving the liver that went undiagnosed or treated at the time of the Urgent Care visits which then progressed and spread into the blood stream and then to the eyes where it did severe, permanent damage. The client’s economic losses and current and future care needs were presented through our economic, vocational and life care planning experts. This case settled following a lengthy Mediation process.
