New Jersey Birth Injury Lawyers: Zofran Lawsuit Alleges Failure to Warn

One of the most recent lawsuits filed against GlaxoSmithKline (GSK) regarding its drug Zofran alleges that GSK engaged in wrongful conduct and fraudulent misrepresentation, directly resulting in a child being born with severe congenital heart defects. This is just one of a number of Zofran lawsuits filed against GSK alleging that the drug has harmful side effects on unborn children when taken by a pregnant mother.

Zofran, also known as ondansetron, is a prescription medication developed to treat severe nausea and vomiting in cancer patients undergoing chemotherapy treatment or in surgical patients. Eventually, Zofran began to be prescribed for morning sickness, an “off-label use” of the drug. Off-label uses are not approved by the Food and Drug Administration (FDA). When some women took the drug as prescribed by their physicians, their children suffered heart defects and other birth defects.

In Louisiana, a mother was prescribed Zofran for morning sickness during her first trimester. Despite taking the drug as prescribed, her child was born with multiple congenital defects, including an enlarged right ventricle and pulmonary atresia. Pulmonary atresia is associated with numerous severe complications including seizures, stroke, delayed growth and development, heart failure, infections endocarditis and death. Symptoms of pulmonary atresia develop immediately after birth and include a bluish tint to the newborn’s skin, rapid, shallow breathing and poor feeding. The newborn was forced to undergo surgery immediately after he was born and required extensive follow-up treatment. Sadly, he continues to suffer from developmental delays and a decreased quality of life.

The parents, residents of Louisiana, allege negligence, fraudulent misrepresentation, failure to warn and other counts. They allege that although GSK received many reports of birth defects associated with Zofran, the pharmaceutical giant failed to disclose this information to expectant mothers and their doctors. The parents are seeking compensatory damages for medical expenses, past, present and future, pain and suffering and punitive damages. They have demanded a jury trial in the U.S. District Court for the Western District of Louisiana Lafayette Division.
