New Jersey Medical Malpractice Lawyer: Delayed Treatment Results in Amputation

A 46-year-old father of three has filed a medical malpractice lawsuit against Coney Island Hospital in Brooklyn Federal court seeking $24 million in damages. According to the claim, delays in treatment allegedly caused the plaintiff to lose his leg, and the amputation could have been prevented with proper, timely medical care.

The plaintiff was struck by a car on September 22, 2015 shortly after 6:00 a.m. while on his way home from work. He was rushed to Coney Island Hospital where doctors determined within an hour that he would need emergency vascular surgery to save his leg. Because Coney Island Hospital did not have a vascular surgeon on staff, it was necessary to transfer the patient to Kings County Hospital for the surgery.

According to the Western Journal of Emergency Medicine, failure to reestablish blood flow to a leg within six to eight hours after this type of injury is likely to result in amputation. The patient was not transferred to Kings County Hospital until after 2:00 p.m. Once transferred, hospital staff realized that his CT report had not been sent with him. Kings County would have to perform another CT scan. It was 7:00 p.m. before the plaintiff’s surgery began, 13 hours after his injury occurred, and by then it was too late for doctors to save his leg.
